Have A Change In Owner Status For Land or Mineral Rights?
Changes in ownership or owner status for land and mineral rights require changes in division orders. Owners will need to provide the appropriate documentation, which is outlined below for each type of change. All ownership changes MUST be filled at the county courthouse where the land is located.
Royalty Interest payments will be suspended, for your protection, in the event of a title dispute, assignment of interest, notice of death, transfer or sale of property, divorce proceedings, and when there is an unknown address. Payments due are accumulated and released once the necessary documents are received by Dara Energy to correctly update accounts. All documents required for changes to owner accounts or ownership changes should be mailed to the following address:

Types of Owner Changes
There are several types of owner changes and each change may require you to provide different documents to Dara Energy. Click on the type of change from the list below for more information and a list of the documentation required.
Change of Address
Please mail change of address requests to the address listed below. Don’t forget to sign the request and include an effective date. Address changes CANNOT be handed by telephone – a signed written request is required. You may email signed and completed forms to info@daraenergy.com or use the address listed below. Send completed forms to Dara Energy, 120 Prosperous Place, Suite 301, Lexington, KY 40509.
Name Changes
If your name changes due to marriage or divorce, please provide Dara Energy with a copy of the Marriage Certificate with the new last name or Divorce Decree reinstating the maiden name.
Company or Corporation Name Change
If the name of the company or corporation changes, please provide Dara Energy with a certificate of Name Change including the new Tax ID Number.
Company or Corporation Name Change Due Merger
If the name of the company or corporation changes due to a merger, please provide Dara Energy with a certificate of merger, including the new Tax ID Number.
Appointment of Attorney-In-Fact / Power of Attorney
If a Power of Attorney has been executed, please provide Dara Energy with a court issued copy of Power of Attorney and any address and/or contact information changes.
Sale of an Interest / Property
If the property with the mineral interest is sold or the mineral interests are assigned to another person, you will need to provide Dara Energy with a recorded copy of conveyance (deed or assignment) filed of record in the county in which the property is located and a W-9 for the new owner.
Ownership Change Due to Divorce
If ownership changes due to a divorce, please provide a copy of the complete Divorce Decree including Settlement Agreement and any applicable recorded conveyances to Dara Energy. A W-9 must also be completed by the party retaining the interest in order to confirm address and social security number to report income earned. Once notified of a pending divorce, account(s) will be temporarily suspended until Dara Energy receives the necessary paperwork to transfer interests to the rightful owner.
New Trust / Partnership Created
In the event that a new Trust or Partnership is created, please provide Dara Energy with a recorded copy of Trust or Partnership and Tax ID.
Trust / Partnership Dissolved
In the event that a new Trust or Partnership is dissolved, Please provide Dara Energy with a recorded copy of the Dissolution of Trust or Partnership, updated contact information, and appropriate Tax ID.
Change in Trustee
If there has been a change in trustee, please provide Dara Energy with a copy of the Trust Agreement and instruments evidencing the death, resignation, or removal of the current trustee and appointment of successor trustee. Also, provide updated contact information for the new Trustee.
Death of an Owner - Will Probated (In County)
If an owner died with a will (testate) and probate proceedings are to be conducted in the county where the property is located:
You will need to provide Dara Energy with the following documents to transfer the interests to the rightful heirs.
- Copy of the Death Certificate
- Court Order Admitting Will to Probate
- Letters of Testamentary (Order Appointing Executrix/Executor of Estate)
- Recorded Copy of Last Will and Testament
- Final Decree of Distribution or Judgement of Possessions
- Completed W-9 Forms for Each New Owner (Federal Law Requires Withholding)
- Return any un-cashed checks made to the deceased. Dara Energy will reissue them to the rightful heirs once all requested documents have been received.
Death of an Owner - Will Probated (Out of County)
If an owner died with a will (testate) and probate proceedings are to be conducted in a county other than the county in which the property is located:
All ownership changes must be filed at the county courthouse where the land is located. You will need to provide Dara Energy with the following documents to transfer the interests to the rightful heirs.
- Copy of the Death Certificate
- Court Order Admitting Will to Probate
- Letters of Testamentary (Order Appointing Executrix/Executor of Estate)
- Recorded Copy of Last Will and Testament
- Final Decree of Distribution or Judgement of Possessions
- Completed W-9 Forms for Each New Owner (Federal Law Requires Withholding)
- Return any un-cashed checks made to the deceased. Dara Energy will reissue them to the rightful heirs once all requested documents have been received.
- Estate Federal Tax ID, if established. If not established, funds will be suspended until the Final Decree of Distribution is issued. It typically takes 6 months for an estate to settle in the state of Kentucky)
- Documentation of ancillary probate proceedings opened in all affected states OR, if ancillary probate proceedings have not been commenced, Affidavit of Heirship.
Death of an Owner Without A Will (Intestate)
Laws of Descent and Distribution will apply as relevant to determine the rightful heirs. All ownership changes must be filed at the county courthouse where the land is located. You will need to provide Dara Energy with the following documents to transfer the interests to the rightful heirs.
- Copy of the Death Certificate
- Court Issued Copy of Letters of Administration (Order Appointing Executrix/Executor of Estate)
- Final Decree of Distribution
- Recorded copy of Affidavit of Heirship
- Completed W-9 Forms for Each New Owner (Federal Law Requires Withholding)
- Return any un-cashed checks made to the deceased. Dara Energy will reissue them to the rightful heirs once all requested documents have been received.
- Estate Federal Tax ID, if established. If not established, funds will be suspended until the Final Decree of Distribution is issued. It typically takes 6 months for an estate to settle in the state of Kentucky
Estate Files Bankruptcy
If the estate of the deceased is going into Chapter 11 or Chapter 13, Dara Energy will need copies of the following documents:
- Copy of the Death Certificate
- Plan of Reorganization
- Court Order Confirming the Plan of Reorganization
- Court Order Naming Trustee of Bankruptcy Estate
